If you receive a parking ticket, first check who issued it and what it says. Council Penalty Charge Notices and private Parking Charge Notices share the initials PCN, but their legal basis and appeal routes differ. A police Fixed Penalty Notice is different again.
This guide provides general information, mainly for England and Wales. Procedures in Scotland and Northern Ireland can differ. Check the notice and official guidance for the place where the vehicle was parked.

Council penalties and private charges
A council Penalty Charge Notice is usually a civil penalty for a parking contravention. It may be attached to the vehicle or served another permitted way. Council enforcement can progress through a statutory process if you neither pay nor challenge within the required time.
A private Parking Charge Notice is usually a claim under the car park’s terms. A valid charge can be payable without the operator first winning a court case. If disputed or unpaid, the operator may bring a civil claim, normally in the County Court in England and Wales. It is not a prosecution in the Magistrates’ Court.
The fact that a charge is private does not make it optional. Equally, receiving a demand does not establish that every charge or added fee is valid. Check the circumstances and seek advice if necessary.
Check the details and evidence
- Compare the registration, location, dates and times with your records.
- Keep photographs of signs and markings, payment receipts, app confirmations and any permit.
- Request the issuer’s photographs or video through its official service where available.
- Explain relevant circumstances, such as a breakdown, an emergency or a payment-system problem, with supporting evidence where possible.
- Keep copies and proof of submission, and make a note of the next deadline.
An error, broken machine or short overstay does not guarantee cancellation. The applicable rules, other payment options, signs and evidence matter. Double yellow lines generally restrict waiting; they do not mean every brief stop is prohibited in every circumstance. Separate loading restrictions and exemptions may apply.
Challenging a council PCN
Follow the instructions on the notice. Depending on how it was served, you may first make an informal challenge or proceed to formal representations. If you receive a Notice to Owner, respond to that document even if you previously wrote to the council, unless the authority confirms the case is closed.
If formal representations are rejected, the Notice of Rejection should explain the independent appeal route and deadline. The relevant tribunal depends on the location. You can normally represent yourself; paying a solicitor is not a requirement.
Read GOV.UK’s challenge guidance. Paying usually closes the case and removes the ordinary appeal route. Consider the evidence and deadlines before deciding, rather than paying first and assuming you can appeal afterwards.

Challenging a private parking charge
Send your challenge to the operator using its stated process. Explain why you dispute liability or ask it to consider the circumstances. You can also ask the landowner or business to consider cancellation, but that request does not automatically pause the operator’s deadlines.
If the operator rejects your challenge, check whether its rejection offers an appeal to POPLA or the Independent Appeals Service. Eligibility, time limits and terms depend on the scheme and type of appeal. Do not assume a universal 21-day, 28-day or 56-day rule applies to every private case.
An operator’s trade association membership affects access to industry appeals, but lack of membership is not proof that the charge is invalid or that it obtained information unlawfully. Do not ignore a claim solely for that reason.
Who is responsible, and does a late notice matter?
For council civil penalties, liability normally rests with the owner, subject to statutory grounds and exceptions. Being someone other than the driver is not, by itself, always a defence.
For private parking in England and Wales, Schedule 4 of the Protection of Freedoms Act 2012 can allow recovery from a keeper or hirer if its conditions are met. There are different notice requirements depending on how the charge was issued. A letter arriving after 14 days does not automatically cancel every parking charge, and failure to establish keeper liability does not necessarily remove a claim against the driver.
Do not apply these England and Wales rules automatically to Scotland, Northern Ireland or land governed by separate statutory rules.
Discounts and escalation
Check the exact discount and payment dates on your notice. An appeal may mean losing the opportunity to pay a reduced amount. Whether a discount is held or offered again depends on the relevant procedure and issuer’s policy.
For council PCNs, a charge certificate can increase the penalty by 50%, followed by debt registration and possible enforcement if the required steps are taken. A charge certificate is not normally a fresh appeal opportunity. However, specific procedural remedies may exist if notices were not received or another permitted ground applies. See the official recovery-stage guidance and get advice promptly.
A private parking charge does not automatically affect your credit record. Ignoring court papers can lead to a default judgment. The rules on judgments and credit records are different from the initial parking demand.
Lost ticket or difficulty paying?
Contact the issuer through independently checked contact details with your registration and the date and location. There is no single public checker covering every parking ticket. If you cannot afford a valid charge, ask about payment arrangements; acceptance is not guaranteed.
