Do You Have to Pay?

In some circumstances, you might have a legitimate reason not to pay your fine.

It’s a bit sneaky, but the last time I needed legal advice, I paid £5 for a trial to chat with an online solicitor called JustAnswer.

Not only did I save £50 on solicitor feeds, I also won my case and didn’t have to pay my £271 fine.

So, who exactly is Parkmaven and why would they fine you?

Parkmaven is one of the many private operators that manage car parks for landowners. The operator is recognised by the British Parking Association (BPA) and is therefore an accredited member.

It means Parkmaven is obliged to follow the Code of Practice set out by the BPA when they fine you. When an operator gets it wrong or doesn’t abide by the ‘Code’, you should be in a position to make a successful appeal.

When should you appeal a Parkmaven fine?

You have 28 days to appeal a Parkmaven fine. But challenging the parking charge within two weeks is something worth thinking about.

First, if the operator rejects your appeal, you get to pay a reduced fine. Second, when you appeal a parking charge, the operator no longer chases you for payment.

To clarify, once Parkmaven receives your appeal against a parking charge, they can’t chase you while they consider your appeal.

What reasons could you use to appeal a Parkmaven fine?

Parkmaven must consider your appeal provided you have good reason for having the parking charge cancelled. So, what excuses are acceptable? I’ve listed some here:

  • The parking charge was incorrectly served
  • You parked correctly and paid the right fee
  • You didn’t own the vehicle when the fine was issued
  • The fine arrived through your letterbox more than fourteen days after you used a Parkmaven car park
  • The road markings were faded and the signs were unclear or missing
  • The parking charge seems excessive
  • You couldn’t pay because the machines were out of order
  • An emergency prevented you from getting back to your vehicle in time
  • You had broken down and waiting for a tow truck
  • The operator issued the parking charge without giving you the obligatory grace period
  • You got the fine in the mail but there were no signs indicating surveillance cameras were being used in the car park

How to avoid paying Parkmaven parking tickets

If you want to avoid paying a Parkmaven parking ticket then you’ll need an airtight appeal.

The best way to perfect your appeal is getting a little advice from a Solicitor. I’d 100% recommend spending a fiver to get a trial of JustAnswer.

You can explain your situation in their chat and they’ll connect you with a Solicitor who can advise you and give you the best chance to win your appeal.

Should you just ignore a Parkmaven fine?

No. It’d be a mistake to ignore a parking charge from Parkmaven. You may think the fine is unenforceable, or illegal. But you could face going to court if the operator chooses to chase you for payment. That’s a worst-case scenario.

Parkmaven could send your details to a debt collection agency. So, it’s a debt collector who chases you for payment which is never a good thing. But before any of this happens, the operator sends out the following:

  • Payment reminders
  • Payment demands
  • Letters threatening court action

Hire a Parking Solicitor for less than a coffee.

If you’re thinking about appealing your parking ticket then getting some professional advice is a good idea.

Getting the support of a Solicitor can make your appeal much more likely to win.

For a £5 trial, Solicitors from JustAnswer can look at your case and help you create an airtight appeal.
