There are several debt solutions in the UK, choosing the right one for you could write off some of your unaffordable debt, but the wrong one may be expensive and drawn out.

Should you reply to a JCIA letter?

Yes. You should reply to a JC International debt letter even when the debt isn’t yours or you believe it’s too old to enforce.

You should write to the debt collection agency telling them to stop contacting you because they’re:

  • Firstly, contacting the wrong person because the debt isn’t yours and the details in their letter are incorrect
  • Secondly, the debt is too old to enforce because its statute barred

You should send the letter by registered mail so you know JC International Acquisition receives it. Plus, do NOT sign the letter, just print your name.

Is the debt yours?

After checking whether a debt is too old to enforce, you should find out if the debt is really yours.

The debt collection agency could be chasing the wrong person due to a clerical error. Or maybe, JCIA has sent the same letter out to hundreds of people hoping to find the right debtor!

Moreover, any proof that JC International Acquisition LLC provides must be authenticated by the creditor. If debt collectors can’t provide evidence that you owe money, they can’t begin further action against you.

Do not just accept their word for it and make sure you send an unsigned letter to JCIA by registered post!

Can JCIA authenticate copies of credit agreements?

No. JC International Acquisition LLC must have copies of the original contracts or credit agreements you signed.

As mentioned, only the original creditor or authorised body can authenticate the copy!

Not the debt collection agency.

Should you offer a partial payment?

You could offer a partial payment but only after you seek advice from an independent debt adviser. That said, debt recovery companies are not obliged to accept a partial payment offer.

However, don’t admit, sign or pay anything with JCIA Ltd until they prove the debt is yours!

Why wouldn’t JCIA accept your debt settlement offer?

JCIA Limited might reject your debt settlement offer for a number of reasons. Maybe it’s because the offer was far below what is actually owed.

Although JCIA probably purchased the debt for pennies in the pound, they may want to recover a high percentage of the debt. If so, they could reject your first offer to settle things.

What happens when you ignore JC International?

Ignoring debts can lead to more stress and anxiety! Like most debt collection agencies,  JC International Acquisition can be persistent and could bombard you with phone calls.

Apart from that, you may find that important information about a debt goes by the wayside. Things like:

  • The debt is too old to enforce and meets the right criteria
  • You don’t even owe money to the original creditor and JC International can’t prove you do

What can JC International Acquisition legally do?

JC International Acquisition is a CSA member and must, therefore, follow a Code of Conduct.

JC International Acquisition LLC has the right to do the following when attempting to recover money owed:

  • Contact you by phone, text, email, or letter or they can visit you in person if all other methods fail
  • Discuss things with you politely and discreetly. According to the CSA Code of Conduct, debt recovery companies must show empathy and take your personal circumstances into consideration when setting up a payment arrangement

As JCIA Ltd buys debts from other companies, the money owed is payable directly to them.

What can’t JCIA legally do?

There are actions and things that debt recovery companies can’t do when they chase you for money owed.

For example, a debt collection agency would be acting unlawfully if they do any of the following:

  • Harass you with constant phone calls, emails, texts etc
  • Threaten you
  • Discuss a debt with your neighbours, boss, friends or even with a family member
  • Visit you when you are at your place of work
  • Pretend their legal power is the same as that of a court-appointed enforcement officer (bailiff)
  • Show you documents and other papers which seem to be issued by the courts
  • Force their way into your property, clamp vehicles or seize possessions
  • Urge you to take out a loan to settle the money owed

You can file a complaint with the company if they breach privacy laws, act unlawfully or refuse to leave when you ask them to.

After filing a complaint with JCIA’s head office, you have the right to file one with the Financial Ombudsman Service (FOS).

If the FOS finds that a debt recovery company acted unlawfully, you could receive compensation.

Would JC International take you to court?

Yes. When you ignore a debt letter or you refuse to pay a proven JCIA debt, you could face getting a county court order to pay.

However, a debt collection company must send you a Letter Before Action (LBA).

When you ignore the notice of intended prosecution, you could get a County Court Judgment (CCJ) on your credit file that’ll harm your credit rating.

A CCJ on your credit report will make it hard for you to get a credit card, bank loan or mortgage for six years!

You may also find that enforcement agents are instructed to recover the money owed. They could visit your home and seize possessions.

Should JCIA let you seek advice?

Absolutely. It’s your right to discuss a debt problem with an independent adviser. JC International Acquisition must allow you enough time to do so.

It prevents them from escalating the matter until you’ve researched all the debt solutions available.

You must find the right debt management plan to suit your personal circumstances. Or you could land yourself in more financial difficulties.
