Could you legally write off some debt?

There are several debt solutions in the UK, choosing the right one for you could write off some of your unaffordable debt, but the wrong one may be expensive and drawn out.

Answer below to get started.

How much debt do you have?

Should you pay CRS Debt Collectors straight away?

No. You don’t have to pay CRS Debt Collectors straight away. But don’t ignore things either. Instead, seek free impartial advice from a debt charity and ask CRS to ‘prove’ the debt is yours.

You should only admit, sign or pay anything to CRS once they’ve proved you owe the money. Then, you should try to negotiate an affordable repayment plan with CRS!

What should you do when CRS contacts you?

You should ask CRS Debt Collectors to prove the debt is yours before you admit, sign, or fork out any money to them. You have the right to make this request and CRS must respect it!

Do not accept verbal confirmation that the debt is yours. It’s not good enough for CRS to simply say, ‘we know the debt is yours’! Debt collection agencies must provide written, authenticated proof that you owe the money.

If CRS can’t ‘prove’ the debt is yours, they can’t make you pay!

You could report CRS to the Financial Ombudsman Services (FOS) if CRS continues to harass you!

How a debt solution could help

Some debt solutions can:

  1. Stop nasty calls from creditors
  2. Freeze interest and charges
  3. Reduce your monthly

A few debt solutions can even result in writing off some of your debt.

Here’s an example:

Situation

Monthly income £2,504
Monthly expenses £2,345
Total debt £32,049

Monthly debt repayments

Before £587
After £158

£429 reduction in monthly payments

What happens if you keep ignoring debt?

CRS Debt Collectors could advise the original creditor to sue you in a small claims court if you ignore them. You could end up with a CCJ on your credit history if the original creditor follows through on the threat of legal action!

What can CRS Debt Collectors legally do?

CRS like all regulated debt collection agencies must follow the law and the Code of Practice when recovering debts.

Not all do!

So, it’s important to know your rights and what CRS can and cannot do when they contact you.

Thousands have already tackled their debt

Every day our partners, The Debt Advice Service, help people find out whether they can lower their repayments and finally tackle or write off some of their debt.

Can you stop CRS Debt Collectors from contacting you?

No. CRS Debt Collectors have the right to contact you over an alleged debt. But you can dictate the terms of how and when they do!

So, if you prefer to deal with the matter in writing only, you can write a letter to CRS asking them to respect your wishes. If they choose to ignore your request, it could be seen as CRS harassing you!

It’s against the law for debt collectors to harass you over an alleged debt!
