Could you legally write off some debt?

There are several debt solutions in the UK, choosing the right one for you could write off some of your unaffordable debt, but the wrong one may be expensive and drawn out.

Should I pay CCSCollect?

You should only pay CCSCollect if you’re sure the debt is yours and you can afford it. But first, before forking out any money, you should:

  • Ask CCS in writing to ‘prove the debt’ is yours!
  • Check how old the debt is because if it’s six years old, it’s unenforceable!

Debt collectors must respect your request to prove the debt is yours. They can’t just tell you verbally that it is. CCS must provide authenticated evidence in the form of an agreement you signed!

A debt that’s six years old is deemed statute barred. Therefore, CCS can’t chase you for it. Plus a court won’t issue a CCJ against you!

That said, a debt is only statute-barred when:

  • You haven’t admitted the debt is yours
  • You didn’t pay any money towards paying off the debt within the last six years
  • There isn’t an existing order to pay the debt

What happens when you don’t pay Vodafone?

Vodafone is never slow to let you know about a missed payment! So, the first letter you get is typically a payment reminder from them. The letter tells you a payment is ‘overdue’.

Vodafone marks your account as ‘in arrears’ when you still don’t pay the outstanding and miss a few more payments. Then, you could find your number is no longer working. In short, Vodafone cuts you off!

At this point, you could settle the outstanding and get your service back!

But if you don’t pay, your account goes into ‘default’ and your Vodafone contract could be cancelled! It’s at this juncture that Vodafone may start its debt collection process.

Vodafone uses CCSCollect to chase you for the outstanding owed to them!

How a debt solution could help

Some debt solutions can:

  1. Stop nasty calls from creditors
  2. Freeze interest and charges
  3. Reduce your monthly

A few debt solutions can even result in writing off some of your debt.

Here’s an example:

Situation

Monthly income £2,504
Monthly expenses £2,345
Total debt £32,049

Monthly debt repayments

Before £587
After £158

£429 reduction in monthly payments

What happens if I don’t pay CCSCollect?

CCSCollect could escalate things when you don’t pay or respond to their correspondence. Moreover, Vodafone may have sold the debt to CCS who can be extremely persistent when it comes to collecting what’s owed!

Don’t ignore CCS because the debt collection agency could take you to court. The result? You’d get a judgement levied against you and a CCJ will affect your ability to get credit.

A CCJ stays on your credit history for six years!

Also, CCS could keep reporting you to credit bureaus which also negatively impacts your credit rating.

Does CCSCollect affect credit score?

Yes. If CCSCollect wins a case against you in court, a CCJ is registered on your credit report. A County Court Judgement stays on your credit history for six years unless you pay the debt within 30 days.

It’d ruin your chances of getting credit in the future!

What can CCS Collect do when contacting you?

CCS Collect is regulated by the Financial Conduct Authority (FCA) and must follow the law when contacting you. The Code of Practice dictates what a debt collector can and cannot do.

For example, CCS Collect can legally:

  • Contact you and visit you at home
  • Ask you to pay them directly
  • Discuss the problem discreetly and politely with you

A debt collector cannot do any of the following and if they do, they’d be acting unlawfully:

  • Force their way into your home
  • Clamp your vehicle
  • Seize your possessions
  • Pretend they are enforcement agents (bailiffs) which is unlawful
  • Discuss a debt with your friends, family, neighbours or employer which breaches the privacy laws
  • Use legal jargon to confuse you
  • Force you to take out another loan to pay them
  • Use deceitful means to get you to pay

Debt collectors must talk to you politely and show empathy and understanding! If they do not, you have the right to report them to the Financial Ombudsman.
