Your letter should stop them from contacting you further!

If the debt is still current, write to Kearns asking them to prove the debt is yours. Debt collectors must respect your request. It’s a legal obligation for them to provide authenticated proof you owe the money.

A debt collector can’t just tell you that you owe the debt. They must provide solid proof. If they can’t prove you owe the money, they can’t force you to pay. 

If Kearns starts legal proceedings against you without proving the debt is yours, you can tell a judge they ignored your request.

It adds strength to your case and might even get you out of paying!

What can Kearns Solicitors legally do?

  • Pretend they have the same powers as a court-appointed enforcement officer (bailiff) which is a criminal offence
  • Use legal jargon to confuse you
  • Show you documents that seem to be official court documents when they are not
  • Threaten or harass you
  • Force entry into your home
  • Clamp vehicles or seize possessions

Can Kearns Solicitors visit you at home?

Yes. Kearns can visit you at home if all other ways of contacting you fail. However, you don’t have to let them into your house.

In fact, you should under no circumstances let a debt collector into your home!

Instead, talk to their representative through the letterbox or an open upstairs window. They can’t infer they are going to seize your possessions either. Only a court-appointed enforcement officer can do that!

Can you complain against Kearns Solicitors?

Yes. You have the right to file a complaint against Kearns Solicitors if they threaten you or harass you over an unpaid debt.

First, file a complaint with Kearns Solicitors’ head office. Then lodge a complaint with the Financial Ombudsman Service (FOS). You must file a complaint with Kearns first though!
