Could you legally write off some debt?

There are several debt solutions in the UK, choosing the right one for you could write off some of your unaffordable debt, but the wrong one may be expensive and drawn out.

Answer below to get started.

How much debt do you have?

This isn’t a full fact find. MoneyNerd doesn’t give advice. We work with The Debt Advice Service who provide information about your options.

Why is there an Arrow Global Debt report on my credit history?

Chances are you have a CCJ on your credit history because you failed to pay a debt Arrow Global Debt was chasing you for. Or maybe you ignored their correspondence and the case went to court.

When a debt collection agency wins the case against you, a CCJ is registered on your credit history! To avoid this happening, try to stay in contact with Arrow Global Debt and work with them to set up a reasonable payment plan.

But make sure you can keep up with the payments to avoid things turning upside down again!

Do I have to pay Arrow Global Debt?

You may have to pay Arrow Global Debt money owed if the debt collection agency can ‘prove’ the debt is yours. That said, the company can’t just say you owe the money because they believe you do!

Arrow Global Debt must provide you with hard proof that you owe the money!

How a debt solution could help

Some debt solutions can:

  1. Stop nasty calls from creditors
  2. Freeze interest and charges
  3. Reduce your monthly

A few debt solutions can even result in writing off some of your debt.

Here’s an example:

Situation

Monthly income £2,504
Monthly expenses £2,345
Total debt £32,049

Monthly debt repayments

Before £587
After £158

£429 reduction in monthly payments

How should you respond to an Arrow Global Debt letter?

When you get a letter about a debt the first thing to do is ask Arrow Global (or Capquest) to prove the debt is yours! You don’t have to do anything until the collection agency provides you with solid proof that you owe the money!

The best way to respond to an Arrow Global debt letter is to be transparent about your finances. So, for instance, if you’re experiencing financial hardship, let the debt collector know.

But only after they provide you with proof the debt is yours! And seek advice from one of the debt charities in the meantime!

Can you ignore an Arrow Global Debt letter?

No. You shouldn’t ignore an Arrow Global Debt letter for several reasons which I’ve listed here:

  • First, the debt may not be yours!
  • Second, you could miss out on being offered an affordable payment plan!
  • Third, you could end up with a County Court Judgement (CCJ) on your credit record!
  • Fourth, the debt may be statute-barred and therefore unenforceable!

Ignoring letters from debt collection agencies doesn’t mean the problem disappears. It just gets worse and more expensive when you don’t deal with a debt problem head-on.

You can contact a debt advice charity if you’re unsure what to do or feel you can’t cope with the situation.

The advice is free and could be invaluable in getting you back on track!

What can Arrow Global Debt legally do?

Arrow Global Debt can legally do certain things to recover a debt. But there are things debt collectors can’t do as well!

For example, Arrow Global Debt can:

  • Call you by phone regarding the debt
  • Send you letters requesting payment
  • Contact you via email
  • Visit you at home
  • Ask you to pay them
  • Start court proceedings to recover a debt

However, debt collection agencies cannot do the following:

  • Contact you at all hours of the day when you’ve written to them requesting that they can only call you at certain times of the day
  • Act in a threatening or intimidating manner in their communications
  • Be deceitful and claim to have powers they don’t have. For instance, pretend they are Enforcement Agents (bailiffs) which is a criminal offence!
  • Force entry into your home
  • Discuss your debt with other people including employers, family members and friends which breaches your privacy
  • Visit you at your place of work
  • Refuse to leave your premises when you ask them to
  • Seize your belongings
  • Clamp your vehicle
