Do You Have to Pay?

In some circumstances, you might have a legitimate reason not to pay your fine.

It’s a bit sneaky, but the last time I needed legal advice, I paid £5 for a trial to chat with an online solicitor called JustAnswer.

Not only did I save £50 on solicitor feeds, I also won my case and didn’t have to pay my £271 fine.

Should I pay for a Devere Parking ticket straight away?

No. You should only pay after you check if the parking ticket was issued according to the IPC Code of Practice.

Plus, there are other things you should check before paying, which include:

  • Was the parking ticket issued on time and within 14 days of the alleged infringement?
  • Did the operator allow you a 10-minute grace period before issuing the Parking Charge Notice?
  • Are the details on the parking ticket correct?

If any of the above applies, you could have grounds to appeal a parking ticket and have it cancelled.

On what grounds could I appeal a Devere Parking fine?

You could have grounds to appeal a Devere Parking Services fine for the following reasons:

  • You did not commit a parking infringement, as stated in the Parking Charge Notice.
  • The details on the parking ticket are incorrect.
  • A medical emergency prevented you from getting back to your car.
  • The operator failed to allow you a grace period before issuing the parking ticket.
  • You were broken down and waiting for assistance
  • The ANPR ‘double dipped’ an entry and exit from a car park
  • You weren’t the driver when the parking infringement happened

You must tell the operator who was driving if you weren’t the driver when the parking ticket was issued.

In short, you must fill out a transfer of liability, which you can do online via the operator’s website.

How do I appeal a Devere Parking fine in Bournemouth?

Devere Parking Services offers you the option to appeal a Parking Charge Notice online via the operator’s website.

According to the operator, they will acknowledge that they received your appeal within 24 hours and should let you know the outcome within 28 days.

It’s worth noting that you must file your appeal in writing no later than 21 days from the date the Parking Charge Notice was issued.

You lose the right to challenge the parking ticket if you don’t meet the 21-day deadline.

Plus, you must provide the following information with your appeal against the parking ticket:

  • The vehicle registration number – VRN
  • The Parking Charge Notice reference number
  • Your grounds to appeal the parking ticket

I suggest you write a convincing letter of appeal that provides enough supporting evidence to have the parking ticket cancelled.

It’s also worth noting that you cannot appeal by email or phone.

What happens if Devere Parking rejects my appeal?

Devere Parking Services sends you a letter of rejection when they don’t accept your reason to appeal the parking ticket.

You then have two options, which are to:

  • Pay the parking ticket. If you appeal within 14 days of receiving the ticket, you get to pay a reduced fine. However, you would pay the full amount if you waited more than 14 days.
  • Escalate your appeal to the Independent Appeals Service (IAS) within 21 days of receiving the rejection letter. Their decision is final, and both parties must respect it.

If the IAS upholds your appeal, the operator must cancel the Parking Charge Notice, and you won’t have to pay.

However, if your appeal doesn’t succeed, you must pay the Parking Charge Notice, which will be the full £100.

What happens when I ignore a Devere Parking fine?

Devere Parking Bournemouth will send you payment reminders/demands to begin with. Each letter is more threatening than the first.

That’s the first step when you ignore a Parking Charge Notice from Devere Parking.

The following steps are more aggressive because the operator could ask a debt collection agency to recover the amount you owe.

Things escalate even further when the debt collector fails to recover the amount owed on an unpaid Parking Charge Notice.

The operator (or the debt collection agency) will send you a Letter Before Action (LBA), which is a notice of their intentions to take you to court.

It’s best not to ignore a Letter Before Action because things get a lot more complicated when you do.

Getting the support of a Solicitor can take a huge weight off your mind.

What if I don’t pay the Devere Parking fine?

The operator will start the process of recovering the money owed them if you don’t pay the Devere Parking fine after losing an IAS appeal.

In short, a debt collection agency would contact you and may even visit your home.

In this instance, it would be the TNC Group Debt Collection.

That said, a debt collector must give you a fair warning before they turn up at your property.

If all methods to get you to pay the parking ticket fail, the operator could take you to court and have a reputation for doing so.

Will Devere Parking take me to court over an unpaid parking ticket?

Yes. There’s always a chance that Devere Parking could take you to court over an unpaid parking ticket.

In fact, it’s the operator’s policy to start legal proceedings when motorists fail to pay a Parking Charge Notice.

Check out one motorist’s message about being taken to court by Devere Parking.
