What Bus Lane Offences Can Result in a Fine From Bradford Council?

There are a number of bus lane-related offences that could result in a fine from Bradford Council. I’ve explained them, below.

  • Driving in a bus lane – The most straightforward offence is simply driving in a bus lane during its hours of operation without authorisation.
  • Entering and stopping in a bus lane – Even if you don’t drive in the bus lane but enter it and stop, you can also be fined.
  • Making an illegal turn across a bus Lane – Some roads require you to cross a bus lane to make a turn. Doing this during the bus lane’s hours of operation can result in a fine.
  • Overtaking within a bus Lane – Overtaking other vehicles while you are driving in a bus lane is typically not allowed and can result in a fine.

Note, not being aware that the bus lane was there is no defence. You are expected to make sure you don’t enter a bus lane, and not seeing signs or road markings isn’t a defence for not being fined.

What Bus Lane Offences Can Result in a Fine From Bradford

Do You Have to Pay the Bradford Council PCN?

Unfortunately, if you receive a PCN from Bradford Council or any other local authority in the UK, you are required to pay it. The PCN should include instructions on how to pay. 

A fine may increase if you do not pay within the specified time, and the local authority may take legal action to recover the debt.

You can challenge or appeal the PCN if you think it was issued incorrectly. Please note that if you challenge the PCN, you may lose the opportunity to pay at a discounted rate if your challenge is rejected. The PCN should also include instructions on how to do this.

Ultimately, if the PCN is valid and you do not pay it or successfully challenge it, the local authority has the legal power to recover the debt, which could include taking you to court or employing a debt collection agency. This could also affect your credit rating. Unless you can find a valid reason to get out of paying the bus lane fine in an appeal.

If You Don’t Pay a PCN From Bradford Council, What Will Happen?

If you do not pay a PCN issued by Bradford Council, the fine won’t just go away. The council will take an ever-increasingly problematic number of steps to get you to pay up, as I listed, below.

  • Increased charge – The charge for the PCN will usually increase. Most councils offer a 50% discount if the PCN is paid within 14 days. If it is not paid within this period, the full amount becomes due.
  • Notice to Owner – If the PCN remains unpaid, the council will send a ‘Notice to Owner’ to the registered keeper of the vehicle. This notice is a formal request for payment and will also provide information on how to pay or challenge the PCN.
  • Charge Certificate – If the PCN is still not paid within 28 days after the ‘Notice to Owner’ has been served, the council may issue a ‘Charge Certificate,’ increasing the amount owed by 50%.
  • Order for Recovery – If the increased charge is not paid within 14 days of the ‘Charge Certificate’ being issued, the council may register the debt at the Traffic Enforcement Centre (TEC) and issue an ‘Order for Recovery.’ Additional fees may be added at this stage.
  • Warrant of Control – If the debt is still not paid after the ‘Order for Recovery’ has been issued, the council may request a ‘Warrant of Control’ from the TEC, allowing them to instruct bailiffs or enforcement agents to recover the debt.

Making an Appeal Against a Bus Land Fine in Bradford

There are some well-defined steps that will happen, if you intend to challenge a bus lane fine from Bradford Council. Below, I have explained these steps.

  • Informal challenge – The first step is to make an informal challenge or representation to the council. This should be done as soon as possible, usually within 14 days of receiving the PCN, as you may be eligible for a 50% discount on the fine if your challenge is rejected but you pay within 14 days. You can use a standard appeal letter template for this.
  • Notice to Owner – If your informal challenge is rejected and you do not pay the PCN, you will receive a ‘Notice to Owner’ from the council. This is a formal request for payment and provides another opportunity to make a formal representation against the PCN. You will have 28 days from the date of the ‘Notice to Owner’ to make a formal representation.
  • Formal representation – If you make a formal representation and it is rejected, the council will issue a ‘Notice of Rejection of Representations’. This notice will include information on how to appeal to an independent adjudicator.
  • Appeal to adjudicator – If you wish to appeal to an independent adjudicator, you must do so within 28. In England and Wales, the adjudicator is part of the Traffic Penalty Tribunal.
