Do You Have to Pay?

In some circumstances, you might have a legitimate reason not to pay your fine.

It’s a bit sneaky, but the last time I needed legal advice, I paid £5 for a trial to chat with an online solicitor called JustAnswer.

Not only did I save £50 on solicitor feeds, I also won my case and didn’t have to pay my £271 fine.

Why have I been given a PCN from Baysentry Solutions?

There are several reasons why you might get a PCN from Baysentry Solutions. It is usually because you have broken the terms and conditions of using a car park that they manage. Some of the reasons include:

  • Not paying
  • Parking in a bay that is designated for parents and children or disabled people
  • Not returning to your car before your paid parking expired
  • Not parking in a bay correctly

Do I have to pay a parking ticket from Baysentry Solutions?

A private company’s parking ticket is an invoice. It differs from a Penalty Charge Notice sent by the police or local governments. The parking fine is issued by the operator to let you know if there was a parking infraction.

It is a civil dispute between a driver and an operator that is governed by contract law. In other words, a private company cannot force you to pay.

They can, however, pursue you for the money. For instance, a private parking lot management business could give a debt collection organisation instructions to recover the money. They might also go to court to get a county court judgment (CCJ) issued against you, which can cause your credit score to decrease and make it harder for you to get credit.

Failure to pay this can also lead to a visit to your home from an enforcement agent, otherwise known as a bailiff.

Paying a Baysentry Solutions PCN

If you choose to go ahead and pay the fine, it is a good idea to do it within 14 days, as you will pay a highly discounted amount – as much as 40% less. You must, however, do it within 28 days to avoid more fees and potential legal action.

You can pay a Baysentry parking fine online or by phone at the Baysentry Solutions phone number using a debit or credit card.

Does that mean I can ignore a parking ticket from Baysentry Solutions?

While they are not legally enforceable, I don’t advise ignoring a parking ticket.

Firstly, if you ignore the parking ticket, the costs will go up. Baysentry Solutions will give you 28 days and plenty of reminders to pay the original fine, before then adding additional fees.

If you still don’t pay, they will more than likely pass your details onto a third-party debt collection agency, who will hound you via post and/or phone for payment. They may then send you a letter before action (LBA), warning you of their intent to take you to court to get the money.

If this happens, you could see yourself with a county court judgment, which will stay on your credit score for six years and affect your ability to take out any form of credit whether that be a mortgage or a mobile phone contract.

Therefore, it is in your best interests to either pay – or lodge an appeal.

Getting the support of a Solicitor can take a huge weight off your mind.

What grounds do I have to appeal my Baysentry Solutions PCN?

To launch a Baysentry Solutions appeal, you need to have reasonable grounds to show that your parking ticket was issued in error or that you were not the driver at the time.

It may include things like:

  • Not being sent the PCN within 14 days of the alleged violation
  • The details on the PCN being incorrect
  • Not being given a grace period before the parking ticket was issued
  • The parking ticket being issued wrongly
  • You were not the driver at the time

As they are part of the British Parking Association (BPA), Baysentry Solutions can get the details of the vehicle’s registered keeper from the DVLA. If this is you, but you were not the driver at the time of the offence, it is your responsibility to pass the details of the driver to the company, along with proof that you weren’t the driver. Without this information, you are still liable.

What happens if my appeal is rejected?

Judging by the Baysentry Solutions reviews on Trustpilot, appeals are often rejected by the company. Fear not though, as if you still believe you are being fined unfairly, you can escalate the appeal to POPLA (Parking on Private Land Appeals). They are an independent body who will look at your appeal and decide whether it was issued correctly and fairly. You must have appealed to Baysentry first, however, otherwise, your appeal will automatically be rejected.

Hire a Parking Solicitor for less than a coffee.
