Why have I received a parking ticket from Ardpark Ltd?

You’ll receive a parking ticket from Ardpark Ltd if you’ve parked in one of their privately managed car parks without obeying their terms and conditions. This is usually by parking in the wrong area or overstaying the allotted time. They will have signage within their car parks detailing the rules.

If you don’t follow their rules, they are authorised by the landowner to give you a ticket. These are usually issued for minor parking infringements such as:

  • Returning to your vehicle after the allotted time
  • Not parking correctly
  • Parking in a space that’s reserved for parents or the disabled
  • Not paying to park

You may have a fine from Ardpark Ltd for breaking any of these rules, but before paying up, make sure the details on the ticket are correct and follow the IPC’s Code of Practice.

Is my Ardpark Ltd fine the same as a penalty charge notice?

No, an Ardpark Ltd fine is not the same as a penalty charge notice. A private parking ticket is called a parking charge notice. It holds the same acronym (PCN), which often leaves drivers confused about their rights and how to appeal.

A private car parking management company can only issue you with a parking charge notice and cannot legally demand payment from you. As mentioned above, you’re only obligated to pay if they take you to court and a judge rules in their favour.

Should I just pay Ardpark Ltd straight away?

No. You should always check the details on the ticket are correct. They may have mistakenly sent you a ticket, or perhaps you never parked in their car park in the first place. You should also check they have followed the IPC’s Code of Practice. You should also check for the following before paying:

  • Did Ardpark Ltd give you a 10 minute grace period before issuing the parking ticket?
  • Is all of the information correct on the ticket, including your registration number and contact details?
  • Has the parking fine been issued within 2 weeks of you allegedly committing a parking offence?

If the details on the ticket are correct and you were in the wrong, I’d recommend paying as soon as possible. If you pay the parking ticket within 2 weeks the price will be reduced.

The Ardpark Ltd website states that their fines are set at £100 and reduced to £60 when paid within 2 weeks. However, the law has recently changed and private car management companies cannot charge more than £50 outside of London. The prices in London are capped at £80.

How can I appeal my Ardpark Ltd parking fine?

When you receive the Ardpark Ltd parking ticket, whether it be on your vehicle or through the post, it will have information on how you can appeal. 

However, it’s worth noting that you must appeal to the private car parking management company within 21 days of receiving your parking ticket.

You will also need to provide solid evidence and a good reason why you feel you shouldn’t pay the parking ticket.

You can appeal your parking ticket online and will get a response within 14 days, letting you know if your appeal was successful or not. Ardpark also has a page where you can make your appeal.

What can I do if my Ardpark Ltd parking ticket appeal is rejected?

If Ardpark Ltd rejects your appeal, you’ll receive a Letter of Rejection (LOR). This letter will have information detailing how you can take the matter to the Independent Appeals Service (IAS) to escalate further if you wish.

You cannot file an appeal with the IAS unless you’ve received a letter of rejection. 

It’s also worth noting that if the IAS rejects your appeal, you will have lost your right to pay the lower amount of the fine.

Can I just ignore my Ardpark Ltd parking fine?

While a private parking ticket isn’t legally enforceable, I wouldn’t ignore it if I were you. They still could take you to court, which could result in you having to pay the fine anyway as well as the court fees.

My advice would be to check the ticket and ensure they have followed the IPC’s Code of Practice before taking any action.

If you ignore the fine altogether, your details could end up being sent to a debt collection agency, meaning you may have to deal with debt collectors on the phone, through the post, or even turn up at your door!

If you ignore all of that correspondence, you may receive a Letter Before Action (LBA), which means the private car parking management company intends to start legal proceedings against you.

Could Ardpark Ltd take me to court if I don’t pay my parking ticket?

Yes. Any private car management company has the right to chase you through the courts for payment if you haven’t paid within 28 days of the ticket being issued.

As mentioned earlier, if you were in the wrong, my advice would be to try and pay within 14 days to pay the lower amount. Plus, once it’s paid there’s nothing hanging over your head!
