Do You Have to Pay?

In some circumstances, you might have a legitimate reason not to pay your fine.

It’s a bit sneaky, but the last time I needed legal advice, I paid £5 for a trial to chat with an online solicitor called JustAnswer.

Not only did I save £50 on solicitor feeds, I also won my case and didn’t have to pay my £271 fine.

If you want to avoid paying a Minster Baywatch parking ticket then you’ll need an airtight appeal.

The best way to perfect your appeal is getting a little advice from a Solicitor. I’d 100% recommend spending a fiver to get a trial of JustAnswer.

Should you appeal a Minster Baywatch parking ticket?

Yes. You may want to appeal a parking ticket if you feel the parking ticket is unfairly or incorrectly issued.

Private operators are duty-bound to follow a Code of Practice when they give you a ticket!

That said, you have 28 days to challenge a Parking Charge Notice. If the operator accepts your appeal, they’ll cancel the fine. But that’s not always the case with many car park management companies!

Should you ignore a Minster Baywatch parking ticket?

No. Ignoring a parking ticket is never a good decision because it won’t stop Minster Baywatch from pursuing you for payment.

Plus, the operator could chase you for payment for quite some time and may even start using a debt collector!

What’s the appeals process?

You have to appeal the parking charge with the operator using their online procedure. Plus, you must have a valid reason for appealing the fine.

Otherwise, it’ll be rejected.

You then have the option to escalate your appeal to an independent appeals service. In this instance, it’d be the Parking on Private Land Association (POPLA).

POPLA assesses your appeal before deciding whether to uphold it or not. If your appeal is rejected a second time, that’s it. You can’t appeal a POPLA decision!

Getting the support of a Solicitor can take a huge weight off your mind.

What’s the best excuse for challenging a parking ticket?

You must have a valid excuse to have a parking fine cancelled. I’ve listed the most common ones in the list below:

  • The Parking Charge Notice arrive over 14 days later than you parked on a site
  • You parked correctly and broke no rules
  • The signs were unclear and/or bay markings faded
  • There was no way to pay
  • The amount is excessive
  • You weren’t the driver when the fine was given
  • You have a valid reason for not getting back in time
  • You had broken down
  • The operator issued the ticket before the 10-minute grace period expired

If the operator accepts your reason for challenging the fine, they’ll cancel the ticket.

How many appeals with POPLA are successful?

In its annual report in 2020, POPLA upheld 41% of appeals it received which represents 4 in 10 motorists who had their parking fines cancelled.

The report shows that POPLA upheld appeals 23,771 times out of 58,522 appeals filed by motorists in that year.

Could you appeal a POPLA decision?

As mentioned, you can’t appeal a POPLA decision to reject your appeal. The only court of action left is to take the operator/landowner to court which could prove costly!

You’d get lots of threatening letters and payment demands from Minster Baywatch which could lead to court action.

Or it could be a scare tactic to get you to pay!

That said, an operator could also get a debt collection company on the case which can be a very unpleasant experience.

It’s a risky decision not to appeal or pay a Parking Charge Notice which could land you in court. If you lose the case or you don’t attend a hearing, you’d automatically get a CCJ for non-payment.

How successful are court cases against private operators?

If the Minster Baywatch issued the Parking Charge Notice correctly, chances are a judge will award the case to them.

But every case is unique and if the operator failed in any way to follow the correct procedure, you stand a better chance of winning the case against them.

An example is if the operator issued the Parking Charge Notice before the mandatory 10-minute grace period had expired!

Lastly, how can you appeal and win Minster Baywatch court cases?

You have the right to appeal a parking charge notice if you think it’s unfair or incorrectly issued. That said, you must have a valid reason to challenge the fine otherwise the operator will reject it!

The only way to win a case in court is to prove the operator failed to follow the Code of Practice when giving you the ticket. You have to weigh up your chances of winning a case before deciding on going to court.

You may be better off paying the parking fine early which means you get to pay a lesser amount. It could save you a lot of time and money. Not to mention the stress of having to attend court.
