Do speed cameras have a margin of error?

Speed cameras are calibrated to take into account a tolerance of 10%+2mph when calculating the speed you are travelling at. It takes into account the error in a speedo’s calibration and that of a speed camera.

However, don’t count on the tolerance because you might get a speeding fine even when you’re just over the allowed speed limit by 2mph!

In short, never assume it’s okay to be over the speed limit by 10%.

Will a speed camera flash when you’re not speeding?

No. Speed cameras don’t usually flash you unless you’re speeding. That said, some speed cameras will not flash at all. But if you’re travelling over the speed limit, you’d still be caught!

Can a speed camera be wrong?

The accuracy of both fixed and mobile speed cameras is deemed extremely high. So, can a speed camera be wrong? Yes, but only by a very small margin! 

That said, motorists who argued that a speed camera was faulty have met with limited success at having a fine quashed!

What is a faulty speed camera?

You could argue that a faulty speed camera is incorrectly calibrated. The result? The equipment fails to register the speed you are going correctly!

But it can be hard to prove the equipment was badly calibrated!

How can you prove a faulty speed camera?

As mentioned, proving a speed camera is faulty is challenging. Evidence that you were speeding is only released by the Police if the case goes to court. If the case doesn’t go to court, the police are not obliged to release any evidence.

Moreover, if you insist on going to court, and you lose the case, you could end up with a heavier speeding fine!

How to report a faulty speed camera (UK)?

You can report the issue to various groups when you think you’ve been flashed by a faulty speed camera. You can also report the issue to:

It’s worth noting that when a report is made about a faulty speed camera, the information is published online.

How long do you have to respond to a NIP for speeding?

The registered keeper must reply to a NIP within the deadline of 28 days. Failure to respond results in court action.

Once the police receive a completed NIP, they can take up to 6 months to issue a Fixed Penalty Notice for speeding. You can accept the fine and penalty points by pleading guilty to the speeding offence.

Or you could file a Not Guilty plea which means the case goes to court!

Is it worth making a faulty speed camera appeal?

Challenging any speeding fine in the UK is not easy. Speeding is an offence. Unless you can prove the fine should be cancelled on a technicality, the chances of success are slim.

Speak to a solicitor first if you believe you could beat a speeding fine because the equipment got it wrong. But be aware that if you lose your case in court, it could cost you a lot more.

How much is a fine for speeding?

A speeding fine could set you back anything from 25% to 175% of your weekly earnings! However, it depends on the seriousness of the speeding offence as to how much you’d be fined.

There are caps on the amount you could be fined which I’ve listed below:

  • The cap on speeding fines issued when you go over the limit on a public road is £1,000
  • The cap on speeding fines issued for exceeding the speed limit on a motorway is £2,500
