Do I have to pay CP Plus Ltd?

You may be wondering whether you have to pay a CP Plus Ltd parking charge. The answer is no. Not straight away.

First, you should check the following before coughing up any money:

  • Did CP Plus allow you a grace period of 10 minutes before issuing the parking charge?
  • Did you park correctly and pay the right fee?
  • Was the parking charge served correctly and did the operator send it through the post within 14 days of the alleged infringement?
  • Did the ANPR get it wrong? There are many instances where ANPR records arrivals and departures incorrectly and where number plates are misread
  • Was the signage in the car park clearly visible and at the entrance of the site?

If you feel any of the above applies to your case, you should immediately challenge the parking charge. Make sure you follow the correct process using CP Plus’s online appeals process!

How to avoid paying CP Plus parking tickets

How should you deal with a CP Plus parking charge?

You could find a CP Plus parking charge stuck to your windscreen. But more likely than not, it arrives in the post thanks to the ANPR the operator uses in their sites. The operator must issue the fine and send it to you on time. No later than 14 days of the alleged parking infringement!

That said, when the fine drops through your letterbox, don’t bin it or ignore it. You should either appeal the charge or pay it – but never ignore a parking charge!

The parking charge is sent to the registered owner’s address because CP Plus gets the details from the DVLA. So, if you’re the registered keeper, the operator sends you the parking charge in the post.

Do I have to pay a parking fine on private land?

No. You don’t have to pay a parking fine on private land unless the operator takes you to court and wins. When this happens, a court orders you to pay the charge which is when a parking charge becomes enforceable.

Can I appeal a CP plus parking fine?

Yes. All motorists have the right to appeal parking tickets they get on private land. Particularly when CP Plus gets it wrong which happens all too often with ANPR!

That said, make sure you have an excuse ready to file with your appeal. Without a good reason for cancelling the parking charge, your appeal stands little chance of success.

Plus, reading some reviews about CP Plus, the operator seems to ignore appeals they receive from motorists!

CP Plus payments appeal, is it worth it?

Yes. It is always worth appealing a CP Plus parking charge. Particularly when the operator got it wrong or the ANPR recorded the wrong information. Just make sure you have enough proof to cancel the fine because the operator has a reputation for rejecting challenges.

On the other hand, you could pay a CP Plus parking charge within 14 days to benefit from the discounted parking charge. But only if you’re satisfied you deserve the fine and the operator served it correctly!

How do I appeal CP Plus?

As mentioned, there’s a process to follow when you appeal a CP Plus parking charge. You must appeal the parking charge on the GroupNexus site.

You must appeal a CP Plus parking charge within 28 days. But choosing to appeal the fine within two weeks is the better option. Why? Because firstly, it’s done and secondly, if the operator rejects it, you get to pay a reduced fine!

You should get a response from the operator within 56 days. Moreover, everything is placed on hold during this time!

After this, you’ll be informed whether the operator accepts your appeal or rejects it. If your appeal is upheld, the parking charge gets cancelled. But if the operator rejects your appeal, you’re sent a letter of rejection.

What happens after an appeal is rejected?

You have two options when CP Plus rejects your appeal. First, you could pay the fine which at this stage would be the full amount. Second, you could escalate your appeal to the Parking on Private Land Appeals service (POPLA).

A CP Plus letter of rejection must contain information on how to do this!

How much would a CP Plus Ltd parking fine set you back?

You could get slapped with a £100 fine for breaking the T&Cs of using a CP Plus managed car park. The good news is this is about to change in 2023 when the government plans to set a cap on how much operators can charge you!

The operator must let you pay a reduced fine when you settle a parking charge early. So, when you pay within two weeks, the amount is reduced by 40%.

What happens if I don’t pay CP Plus?

The parking charge is not a ‘fine’ but an invoice raised by CP Plus because you were found in breach of contract with the operator! The only time a CP Plus fine (invoice) can be enforced is when a court orders you to pay.

CP Plus is not slow when it comes to chasing you when you don’t pay a parking charge on time or not at all! The operator is quick to send you payment reminders, followed by payment demands.

Then, you’ll get a Letter Before Action threatening court action.

The operator also uses a debt collection service to chase you for an unpaid parking charge which is never pleasant. In a worst-case scenario, you could face having to attend a small claims court hearing. Again, not pleasant.

When you ignore correspondence and you don’t pay a court order to pay a CP Plus parking charge, you’d get a CCJ.

The County Court Judgement remains on your credit history for six years!
