Yes. Car park management companies can legally issue you with a Parking Charge Notice. Private landowners authorise them to issue the tickets when motorists don’t follow the ‘rules’.

The ‘rules’ are supposed to be signposted at a car park’s entrance so you can read the T&Cs before parking.

However, although a private operator can legally issue the ticket, a Parking Charge Notice is not enforceable. Not unless the operator wins a court case against you and a judge orders you to pay!

Will BW Legal start legal proceedings for an unpaid parking fine?

BW Legal could advise a client to start legal proceedings against you over an unpaid parking ticket. That said, you may get threats of court action, but the client may not want to follow through!

It’s a bit of a gamble whether you’d face court action or not!

That said, BW Legal would send you a Letter Before Action (LBA). Don’t ignore it, instead, you could opt to pay the fine to avoid going to court.

If you want to avoid the further hassle, you might be better off paying BW Legal over an unpaid parking fine. That said, make sure the fine is yours first! Also, check that the operator issued it correctly according to the Code of Practice if they are accredited, that is!

You shouldn’t ignore the correspondence you get from BW Legal about a parking fine. Chances are they’re chasing you on behalf of a car park management company.

You may have received a Parking Charge Notice in the past and either forgotten all about it or binned the notice! If so, the problem doesn’t go away and the car park operator could instruct BW Legal to recover the amount owed.

If BW Legal is contacting you about an outstanding parking fine, they can call you, email you, and write to you. The law firm can visit you at home if you ignore all their attempts to get in touch with you.

However, you don’t have to open the door to someone from BW Legal. You can write to the law firm dictating when and how you wish to be contacted.

BW Legal must respect your request and if they continue to harass you with constant calls, you should file a complaint with their head office.

Then file complaints with the Financial Ombudsman Services (FSO) and the SRA!
