Do You Have to Pay?
In some circumstances, you might have a legitimate reason not to pay your fine.
It’s a bit sneaky, but the last time I needed legal advice, I paid £5 for a trial to chat with an online solicitor called JustAnswer.
Not only did I save £50 on solicitor feeds, I also won my case and didn’t have to pay my £271 fine.

What are the Asda parking rules?
It would be fair to say that the parking rules at Asda sites are confusing. Especially since the new rules were introduced that don’t allow you to park at night!
On top of this, the operator that manages Asda sites uses Automatic Number Plate Recognition (ANPR) which is not 100% reliable! In fact, the technology often gets it wrong much to the dismay of many motorists.
In short, too many shoppers get a parking ticket because the ANPR records them arriving in a car park, but then fails to record their departure. The shopper returns later on and the system records them leaving hours later!
The result? The motorist gets a Parking Charge Notice in the post that shouldn’t have been issued!
What are the new Asda parking rules?
Asda or the operator introduced new rules to stop ‘boy racers’ using the car parks at night. The problem is that innocent shoppers are also paying the price!
I’ve listed the new rule in the list below:
- There’s no parking in an Asda car park between midnight and 5am every day of the week
- The new rule applies to shoppers even though they should be given 45 minutes of free parking!
Which private car park company manages Asda sites?
The private car park company that manages Asda sites is an operator called ParkingEye.
What’s more, ParkingEye doesn’t charge landowners any money to manage their car parks. They make their money issuing Parking Charge Notices to unsuspecting shoppers and motorists!
Do you have to pay Asda parking fines?
Not necessarily. For instance, you shouldn’t pay the fine without checking a few things first!
Did ParkingEye issue the parking ticket correctly? Are the details on the notice correct? Did you commit a parking violation on an Asda site?
In short, you should establish the following before forking out any money for an Asda parking ticket:
- Make sure all the details on the ticket are yours and correct
- Determine whether you were allowed a grace period
- Did the ANPR record your arrival and departure correctly?
It’s worth noting that unlike Penalty Charge Notices, a parking ticket on private land is an invoice and not a ‘fine’.
Only a court ruling can make you pay a Parking Charge Notice. An operator cannot legally demand payment from you without a court order.

How do you pay an Asda parking ticket?
You can pay an Asda parking fine by using an online payment process. However, you can also settle the ticket in the following ways:
- By phone using a debit or credit card
- By cheque by post
When you pay the parking ticket, you’ll need to provide the following information:
- Your vehicle registration number – VRN
- Parking Charge Notice number
If you’ve lost the reference number, you can contact ParkingEye to retrieve it.
How long do you have to pay for an Asda parking ticket?
The deadline to pay an Asda parking ticket is 28 days. However, if you settle the ticket within two weeks, you pay 40% less!
How much is an Asda parking ticket?
Legislation passed a while back forbidding private operators from overcharging motorists. In short, there’s going to be a cap of £50 on how much ParkingEye can charge you which should come into effect in 2023. Until then, the fine is £100.
However, in London, the charge is capped at £80!
When you settle the parking ticket early within 14 days of receiving it, you pay 40% less!
What if you don’t pay the Asda parking ticket?
If you don’t pay an Asda parking ticket, ParkingEye could take you to court. However, first, you’d get threatening letters followed by a Letter Before Action (LBA).
The operator could pass your details on to a debt collection agency in which case, you’d no longer deal with ParkingEye but the debt collector instead.
It’s worth noting that a debt collection agency has the same legal power as ParkingEye. They can chase you for a payment but they’d have to take you to court to enforce the parking ticket!
That said, if the operator wins a case in court, you could end up with a CCJ on your credit file!

What’s the best excuse for appealing an Asda parking ticket?
You could use several excuses that ParkingEye should consider valid if you opt to appeal the ticket.
I’ve listed some here:
- The signs at the car park entrance were not easily visible or unclear
- You were broken down and waiting for assistance
- You couldn’t pay because the machines were out of order
- The parking ticket arrived in the mail over 14 days after the alleged parking violation happened
- You couldn’t get back to your car due to a medical emergency
- You weren’t given a grace period before the ticket was issued
Make sure your appeal letter sets out all the information needed to challenge the ticket!
Does ParkingEye have to allow a grace period?
Yes. ParkingEye is an accredited car park operator which means they mustn’t issue a ticket to you before a grace period of ten minutes is up. It’s in the BPA’s charter!
However, for this to be applicable, the following must apply:
- You parked correctly
- You paid the correct fee and displayed the ticket correctly in your vehicle
If the parking ticket was given before the grace period had expired, you should insist on it being cancelled!
